The main legal framework includes: Law No. 6502 on Consumer Protection; Regulation on Distance Contracts; Law No. 1136 on Attorneys; Turkish Bar Association Professional Rules and Advertising Ban Regulation; Law No. 6698 on Personal Data Protection and its secondary regulations.
2. Service Provider Information
3. Essential Characteristics of the Service
- Online legal consultation is a legal service provided remotely by Attorney Helin Menteşe Mızrakoğlu or an authorized attorney assigned by the Office, on the scheduled appointment date.
- The consultation will be conducted via video call using Zoom, Google Meet, or WhatsApp, depending on the appointment and technical availability. The channel to be used will be communicated to the client upon appointment confirmation.
- The service may include a legal assessment based on the facts and documents provided by the client, information on legislation and avenues of recourse, and an explanation of the legal roadmap.
- Online consulting does not include litigation/business follow-up, debt collection, court attendance, drafting of petitions or contracts, notarial services, representation before institutions, or ongoing legal advisory services, unless otherwise agreed upon.
- Consultancy services do not guarantee a specific outcome for any particular case, investigation, administrative application, or other legal process.
4. Professional Framework, Confidentiality, and Conflicts of Interest
Legal practice is a public service and a liberal profession, carried out within the framework of professional independence and confidentiality. Information disclosed and documents submitted by the client during the consultation are protected in accordance with applicable legislation and professional rules. If deemed necessary, a conflict of interest check may be conducted prior to the service; if a professional impediment or conflict of interest is identified, the service will not be provided, the appointment will be cancelled, and the fee paid will be refunded in accordance with the legislation.
5. Fees and Payments
The total cost of the service, including taxes, and any payment options, will be displayed on the payment screen immediately before completing the order. The service fee is determined in accordance with the current Minimum Fee Tariff for Lawyers and mandatory provisions regarding legal fees. Payment is made via bank/credit card through the Moka payment infrastructure.
6. Time of Performance and Participation in the Meeting
The service is provided at the date and time selected by the client through the appointment system and confirmed by the Office. The client is responsible for providing suitable equipment, a camera/microphone, and internet connection for the consultation; and for joining the provided connection or consultation channel on time. If the client does not join at the scheduled appointment time, approximately 15 minutes will be waited.
7. Cancellation and Postponement
- Cancellation or postponement requests notified at least 24 hours before the appointment time are processed free of charge.
- If the client wishes, and if availability permits, the appointment can be rescheduled for a later date.
- For notifications received less than 24 hours in advance, postponements will be evaluated by the Office, taking into account the reason for the notification, the appointment schedule, and the specific circumstances.
- In case of mandatory cancellation or technical issues originating from the office, the client will be offered a new date; if this is not accepted or the service cannot be provided, legal refund rights will apply.
- These operational rules do not restrict the consumer's right to withdraw from contract or other rights arising from mandatory legislation.
8. Right of Withdrawal
The consumer may exercise their right to withdraw from the service contract within 14 days of its conclusion, without giving any reason and without paying any penalty, subject to the exceptions stipulated by law. The withdrawal notification can be sent in writing or via a durable data storage medium to danismanlik@helinmentese.com.
According to the Regulation on Distance Contracts, an exception may apply to services that have begun to be performed with the consumer's consent before the expiration of the withdrawal period. Therefore, if the appointment is to take place before the 14-day period expires, separate and explicit information/consent must be obtained regarding the commencement of the service on the selected date.
9. Returns
In service contracts where the right of withdrawal is exercised properly, the amount collected will be refunded within the period stipulated by law, starting from the date the notification reaches the Office, in a manner appropriate to the payment method used by the consumer, and without any additional costs to the consumer. The time it takes for card refunds to be reflected in the account may depend on the technical processes of the bank/payment institution.
10. Interview Recording and Confidentiality
The office does not record audio or video of meetings conducted via Zoom, Google Meet, or WhatsApp. Clients are also required not to record or publish meetings without the office's explicit knowledge and legal basis, due to attorney-client confidentiality, personal data protection, and the rights of third parties.
11. Personal Data and Communication Platforms
Personal data may be processed during the appointment, payment, and consultation process. Details are included in the Personal Data Protection Law (KVKK) Disclosure Statement. Zoom, Google Meet, and WhatsApp are third-party services; depending on the channel used, the provider's own data processing activities and the possibility of international data transfer may also be involved.
12. Complaints and Disputes
Clients can submit their requests and complaints to danismanlik@helinmentese.com or (0312) 466 66 39. For consumer disputes, for the year 2026, applications should be made to the Provincial/District Consumer Arbitration Boards for disputes below 186,000 TL; for disputes of 186,000 TL and above, the provisions of Law No. 6502 regarding jurisdiction and mandatory mediation apply. Since the monetary limit changes every year, the current limit at the time of application will be considered.
13. Confirmation of Preliminary Information
This form must be made available to the client in an accessible manner before any payment obligation arises; confirmation of the client's receipt of the form must be electronically recorded. Approval of the form does not constitute explicit consent under the Personal Data Protection Law (KVKK).
