DISTANCE SERVICE AGREEMENT
1. Parties
CLIENT / SERVICE RECIPIENT: The natural or legal person identified by their name/title, address, telephone, email, and necessary billing information provided during the appointment and payment process. The client acknowledges that the information provided is accurate and up-to-date.
2. Subject Matter and Legal Nature of the Contract
This agreement regulates the scope, performance, and the rights and obligations of the parties regarding the online legal consultancy service for which the Client has made an appointment and paid electronically via online.helinmentese.com. The mandatory provisions of Law No. 6502 and the Regulation on Distance Contracts are reserved for clients who are considered consumers. The professional aspects of legal services are subject to Law No. 1136 on Attorneys, the Professional Rules of the Turkish Bar Association, and related regulations.
3. Scope of Service
- Oral/video consultation and legal assessment regarding the legal issue.
- Information on legislation, avenues of appeal, possible legal options, procedural processes, and risks.
- The information and documents submitted by the client before or during the consultation will be reviewed to the extent permitted by the consultation time.
- Unless otherwise agreed, the scope of the service does not include litigation/case management, drafting of petitions or contracts, representation before institutions/courts, or legal representation services.
4. Agency Relationship and Commitment to Outcome
Purchasing an online consultation appointment does not, by itself, mean that the Office undertakes all of the client's legal affairs. Following the consultation, the handling of litigation, enforcement proceedings, investigations, applications, contract drafting, or other legal work will be evaluated separately, and a separate attorney fee agreement/power of attorney relationship will be established as needed. No legal outcome is guaranteed.
5. Communication Channel and Technical Requirements
The consultation will be conducted via video call using Zoom, Google Meet, or WhatsApp, depending on the technical availability of the office and the client. The platform to be used will be communicated with the appointment confirmation or prior to the consultation. The client is responsible for complying with the terms of use of the relevant application and ensuring the security of their own device/connection.
6. Professional Independence, Confidentiality, and Conflicts of Interest
A lawyer conducts their professional activities with independence, diligence, and a duty of confidentiality. The duty of confidentiality under Article 36 of the Attorneys' Law is reserved. If the office determines, before accepting the service or during the consultation, that there is a conflict of interest or professional impediment, it may refuse the case or terminate the service. In this case, the fee for the service not yet performed will be refunded in accordance with the legislation.
7. Client's Obligation to Provide Information
- The client must provide accurate, complete, and timely information regarding facts that are relevant to the legal assessment.
- If there is a time-sensitive process, notification, hearing, application, or forfeiture period, this must be clearly stated at the beginning of the meeting.
- Clients should refrain from sharing unnecessary personal/private data belonging to third parties.
- The Office cannot be held responsible for any changes in the legal assessment due to incomplete or incorrect information provided by the client.
8. Fees and Payments
The total fee is displayed on the payment screen before placing the order. The current Minimum Fee Tariff for Lawyers and the fee provisions of the Lawyers' Act are taken into account when determining legal fees. Card payments are made via Moka. The installment, authorization, and refund processes of the bank/payment institution are subject to their own technical rules.
9. Appointment and Performance
The service begins at the confirmed date and time. Client delay does not automatically extend the consultation time. If a client does not attend the appointment, approximately 15 minutes will be waited. If the client provides reasonable notice in advance or during the waiting period, the appointment may be postponed to a later date, subject to availability.
10. Cancellation and Postponement
Cancellations/postponements are processed free of charge for notifications made at least 24 hours before the appointment. Requests made less than 24 hours in advance will be evaluated according to the specific circumstances. In case of mandatory cancellation due to office reasons, a new date will be offered, or if the service cannot be provided, the fee will be refunded in accordance with the regulations. This arrangement does not restrict the consumer's legal right of withdrawal.
11. Right of Withdrawal and Early Commencement of Service
The consumer may withdraw from the service contract within 14 days of its conclusion, subject to legal conditions. However, a legal exception may apply to services that have begun to be performed with the consumer's consent before the expiration of the withdrawal period, in accordance with the Regulation on Distance Contracts. If the appointment is within the 14-day period, it must be recorded that the client explicitly requested the service to begin on their chosen date and was informed of the legal consequences of this on their right to withdraw.
12. Returns
In cases where a refund is legally required, the amount will be refunded within the timeframe stipulated by law, depending on the nature of the cancellation/withdrawal notice, in a manner appropriate to the payment method used for the purchase, and without any costs being imposed on the consumer.
13. Failure to Record the Interview
The office does not record audio or video of consultations. Clients are also required not to record, reproduce, publish, or transmit the consultation to third parties without the explicit knowledge of the office and a legally justifiable basis. Confidentiality is particularly important as the consultation may contain information belonging to third parties.
14. Personal Data
Personal data is processed within the scope of the purposes, legal basis, and retention principles stated in the Personal Data Protection Law (KVKK) Disclosure Statement. Reading the disclosure statement does not constitute explicit consent. If there is a separate data processing activity requiring explicit consent, this activity will be presented for approval separately and freely.
15. Technical Disruption and Force Majeure
If the meeting cannot take place due to a platform outage, internet/electricity failure, cyber incident, illness, court hearing, or any other reason beyond the reasonable control of the parties, a new date will be determined first. If the provision of the service becomes impossible, the consumer's legal rights will be enforced.
16. Dispute Resolution
Turkish law applies. For consumer disputes below 186,000 TL in 2026, consumer arbitration boards will handle the matter; for disputes of this amount and above, the current jurisdiction/authority provisions regarding mandatory mediation under Law No. 6502 and consumer courts will apply.
17. Electronic Registration and Enforcement
An electronic record is created when the client can access the contract and provide their acceptance statement during the ordering process. It is recommended that the valid version of the pre-information and contract texts be stored in a way that can be associated with the order on the transaction date.
